Understanding the Essential Documents in Your Estate Plan

Estate planning isn’t just about legal documents—it’s about peace of mind, protecting your loved ones, and ensuring your wishes are honored, both during your lifetime and after. Whether you’re just starting the process or reviewing an existing plan, understanding the core documents involved is a critical first step. Here’s a breakdown of the foundational elements that make up a basic estate plan.

1. The Will – Directing Your Legacy
Your Last Will and Testament ensures that your assets are distributed according to your wishes after your death. In your will, you can:
• Name guardians for minor children
• Direct specific gifts or asset distributions
• Establish a trust if needed
• Appoint an executor—someone you trust to carry out your instructions
To be legally valid, your will must be signed in the presence of witnesses and typically notarized.

2. Durable Power of Attorney for Property – Planning for Incapacity
This document allows you to appoint someone—referred to as your agent—to manage your financial (and property) affairs if you are unable to do so yourself. This can include tasks like:
• Paying bills
• Managing bank accounts or investments
• Handling real estate transactions
Your agent acts on your behalf and has only the powers you specifically grant. It’s important to select someone you trust who is responsible and capable of managing finances effectively.

3. Medical Power of Attorney – Ensuring Healthcare Decisions Align with Your Wishes
If you’re ever in a position where you can’t make medical decisions for yourself, the Medical Power of Attorney empowers a trusted person (“agent”) to do so for you. Your agent may be asked to make decisions about treatments, surgeries, or long-term care. This is a significant responsibility, and we recommend selecting someone who understands your values and will advocate for your healthcare preferences.

4. HIPAA Release – Protecting Your Privacy While Allowing Access
A HIPAA Authorization allows doctors and healthcare providers to share your medical information with individuals you designate— often, your chosen medical agent will be included on this list. This document ensures that your healthcare decision-makers have current information so they can act quickly and wisely.

5. Advanced Directive (Living Will) – Expressing Your End-of-Life Preferences
An Advanced Directive, sometimes called a Living Will, outlines your choices about life-sustaining treatment in situations where you’re unable to communicate, such as a terminal illness or permanent unconsciousness. This document gives your agent and doctors guidance so they can honor your wishes regarding things like resuscitation, feeding tubes, and other interventions. It’s a compassionate way to relieve your loved ones of uncertainty during a difficult time.

Each of these documents involves appointing fiduciaries (executors, agents) —people who will act on your behalf and in your best interest. These individuals should be trustworthy, responsible, and fully aware of the duties they’re taking on. We encourage naming backup choices in case your primary appointee is unable or unwilling to serve. Rules regarding notary and witness will vary by state. As an added layer of protection, a notary is recommended to ensure it’s accepted across all states and institutions.

Together, these documents create a comprehensive estate plan that protects you during life and ensures your legacy is honored after death. Your will takes effect upon passing, while the other documents are designed to support you during your lifetime. If you have any questions, please reach out to your ACM Wealth Advisor.
